General conditions of use.

Volkswagen AG provides the information offered by the personalised services on the basis of the conditions of use. Information on the conditions of use of the corresponding services can be obtained by clicking on the appropriate link.

1. Delivery of information services and related guarantees.

Information contained on these websites has been compiled by Volkswagen AG in a conscientious and thorough manner and attains 97.5% availability on a yearly average.

The contents of these websites are solely for information purposes and are legally non-binding insofar as they are not subject to the stipulations of the energy consumption information directive (details of fuel consumption and CO2 emissions).

Some of the vehicles listed on these pages, for example in the vehicle configurator, are equipped with options at extra charge. Decoration contained in the illustrations is not included in the standard specification. The data given on specifications, appearance, price, performance, weights and dimensions of the vehicles is in accordance with the information available at the time the data was entered. In this respect, it is expressly subject to change without notice. All details of equipment, prices and technical data are based on the features of the German market.

If vehicles are ordered with options classified as “special equipment” this can lead to longer delivery periods. Our vehicles are equipped with summer tyres as standard. As of 1st May 2006 you are required by law in the Federal Republic of Germany to adapt the equipment of your vehicle, in particular the tyres, in wintry weather conditions. Your local Volkswagen Dealer will be pleased to advise you.
For commercial use: in accordance with EU directive 3820/85, a tachograph is stipulated by law as of a gross train weight of 3.5 tonnes. This means that if the vehicle is used commercially, a gross train weight (GVW of towing vehicle plus GVW of trailer) of 3.5 tonnes must not be exceeded. A tachograph is not available for the Caddy ex factory nor can it be fitted subsequently.

Take-back and recycling of end of life vehicles.

VOLKSWAGEN meets the challenges of modern society and takes them into consideration in all new products of the Volkswagen brand. This naturally also applies to protection of the environment and resources. All new VOLKSWAGENS can therefore be recycled in an environment-friendly way and can be returned in EU countries free of charge*. Please refer to www.volkswagen.de for details concerning the take-back and recycling of end of life vehicles or contact your local Volkswagen Dealer.

Note concerning fuel consumption and CO2 emissions of vehicles registered as passenger cars:
the figures listed have been established in accordance with the measuring method stipulated (the version of directive 80/1268/EEC which is currently valid). These figures do not refer to a particular vehicle and do not constitute part of the offer but are purely for comparison purposes between the various types of vehicle.

In addition to the fuel efficiency of a car, driving behaviour as well as other non-technical factors play a role in determining a car’s fuel consumption and CO2 emissions. CO2 is the main greenhouse gas responsible for global warming.

Note in accordance with directive 1999/94/EC:

a guide on fuel consumption and CO2 emissions of new passenger cars, which contains information on the official fuel consumption and official specific CO2 emissions of new passenger cars, is available free of charge at every point of sale in the European Union and, for prospective buyers in Germany, at DAT Deutsche Automobil Treuhand GmbH, Hellmuth-Hirth-Strasse 1, 73760 Ostfildern.

Some of the information provided in association with these services reflects the views of the Volkswagen management. 7. Links to websites of Volkswagen AG.

It is permissible to place hyperlinks to the home pages of Volkswagen websites, such as www.volkswagen.de provided that

• the link causes the target page to be fully refreshed without being placed in a frame,
• the link is notified to Volkswagen AG within 24 hours of being placed by means of an e-mail to links@vw-online.de

8. Liability.

Volkswagen AG accepts liability for cases of intent or gross negligence, in accordance with the German Product Liability Act, and for guarantees expressly given by Volkswagen AG. In cases of minor negligence Volkswagen AG accepts liability only in the event of infringement of an essential obligation, whereby the sum of any related claims for damages is limited to the extent of the foreseeable loss.

9. Security in transmission of messages to Volkswagen AG.

In view of the technical structure of the Internet, if you wish to send an e-mail from your private e-mail account to Volkswagen AG you must take your own security precautions in order to maintain the confidentiality and integrity of your e-mail’s content, by using standard commercially available encryption software for example.

If you wish to send an e-mail directly from the Volkswagen AG contact zone, you should be aware that your data will be transmitted unencrypted and no guarantee can therefore be given as to the confidentiality and integrity of your e-mail’s content.

10. Changes to the scope of performance and to the conditions of use.

Volkswagen AG reserves the right to expand or reduce the service provided, or modify its functionality, in whole or in part, at any time. The rapid development of the Internet makes it necessary for us to amend these conditions of use from time to time. In this respect, please refer to the version of the conditions of use that is currently valid.

11. Choice of law.

The use of services and these conditions of use are subject to German law, with the exception of the conflict of laws provisions it contains.
